Both state and federal law recognize the therapeutic value of emotional support animals, and Nevada protects your right to live anywhere with your emotional support animal – as long as you have a valid ESA letter written by a therapist licensed in the state.
Nevada makes it possible for ESA owners to live in any type of housing – including rental properties – with their emotional support animals. This is in accordance with the federal Fair Housing Act (FHA) and the Americans with Disabilities Act (ADA). Provided that you can present a legitimate ESA letter, your housing provider must make reasonable accommodations for you and your emotional support animal to live together, even if they do not usually allow pets on the premises. Furthermore, landlords are not allowed to impose any pet fees, deposits, or weight or breed restrictions on ESA owners.
When it comes to public establishments, however, the laws are somewhat different. You probably already know that service animals are allowed to accompany their owners in places such as restaurants, stores, hotels, movie theaters, and libraries. However, there is no legal obligation for emotional support animals to be granted admission to these places – the decision is entirely at the discretion of the owner or manager of the establishment. This also includes workplaces and commercial aircraft (as detailed in the Air Carrier Access Act). There's a chance, however, that the venue manager, airline representative, or even your boss will accommodate your emotional support animal if you explain your circumstances and present them with a valid ESA letter. You'll never know unless you ask!
For air travel in particular, be prepared in case the airline rejects your ESA request. If you have enough time to do so, you could still make arrangements for your emotional support animal to fly with you as an ordinary pet.
Only a mental health professional licensed in Nevada has the authority to determine whether you have a mental or emotional disability and a disability-related need for an emotional support animal. If they find that you do, they can make an emotional support animal an official component of your mental health treatment plan.
