Emotional Support Animals in Utah

Anyone with an emotional or mental disability may be eligible for an emotional support animal in Utah.

The state is conscientious of the struggles its residents with mental health conditions face. Utah strives to enact considerate laws and policies to protect those with mental disabilities, as well as their emotional support or service animals.

ESA Laws in Utah

Utah law largely mirrors federal law concerning emotional support and service animals. In addition, an individual who misrepresents a service dog in Utah may face jail time or fines as a result.

Read on for a deeper dive into Utah-specific ESA laws regarding travel, housing, employment, and public access. Become informed of all the rights, protections, and benefits available to you as an owner of an emotional support animal.

Utah ESA Housing Laws

The federal Fair Housing Act (FHA) is in full force in Utah. This act requires housing providers to make reasonable accommodation for a tenant with an emotional support animal or service animal to have their animal live with them in their place of residence.

This law also states that landlords cannot charge any extra fees for bringing an assistance animal—even if the unit typically has a "no pets" policy. The landlord also cannot impose any weight or breed restrictions on your animal, and can only refuse them if they cause extensive damage on the property or pose a direct threat to the safety of others.

Utah Fair Housing & Employment Act

No specific state or federal law in Utah requires employers to allow an employee to bring an emotional support animal to work (although, in most cases, they must allow service animals).

Keep in mind, however, that this decision is at the discretion of employers, and under the Americans with Disabilities Act (ADA), they must not discriminate against an employee for having a disability. Because of this, some employers may choose to be lenient and empathetic to your situation.

If you feel your emotional support animal would benefit you by accompanying you to the workplace, bring your ESA letter and ask your HR department if they might be willing to accommodate you and your companion animal.

How Do You Qualify for an ESA in Utah?

To qualify for an emotional support animal in Utah, you first need to meet with an LMHP licensed in your state. They can evaluate your condition and symptoms to determine if an ESA would be a good fit for you. If so, they will write you an ESA letter to make it official.

Working through a telehealth marketplace, such as Pettable, makes this process easier than ever. You can schedule a live consultation with a vetted clinician without dealing with the hassle. Every one of our LMHPs is familiar with the ESA laws in their state and experienced in working with clients who own assistance animals.

Verified customers. Real reviews.

I had an incredible experience with Pettable. I had just moved and was looking for a new therapist, but knew an ESA would really help me with the transition, so I came to Pettable to get documentation so I didn’t have to wait months to get approval from my landlord to bring a pet home. The process was straightforward, timely, and made me feel so valid in my journey. Now I am raising a puppy and never been happier and healthier! I can’t recommend Pettable enough!

My pup provides relief in stressful situations, particularly when I'm away on necessary travel. Pettable was an amazing resource, connecting me with a therapist who listened to my situation and provided advice above and beyond. I could hear Rhiana's compassion over our call and appreciated her patience. Grateful for this service!"
