Emotional Support Animals in Utah

Anyone with an emotional or mental disability may be eligible for an emotional support animal in Utah. 

The state is conscientious of the struggles its residents with mental health conditions face. Utah strives to enact considerate laws and policies to protect those with mental disabilities, as well as their emotional support or service animals.

Utah ESA Housing Laws

The federal Fair Housing Act (FHA) is in full force in Utah. This act requires housing providers to make reasonable accommodation for a tenant with an emotional support animal or service animal to have their animal live with them in their place of residence. 

This law also states that landlords cannot charge any extra fees for bringing an assistance animal—even if the unit typically has a "no pets" policy. The landlord also cannot impose any weight or breed restrictions on your animal, and can only refuse them if they cause extensive damage on the property or pose a direct threat to the safety of others.

Utah Fair Housing & Employment Act

No specific state or federal law in Utah requires employers to allow an employee to bring an emotional support animal to work (although, in most cases, they must allow service animals). 

Keep in mind, however, that this decision is at the discretion of employers, and under the Americans with Disabilities Act (ADA), they must not discriminate against an employee for having a disability. Because of this, some employers may choose to be lenient and empathetic to your situation. 

If you feel your emotional support animal would benefit you by accompanying you to the workplace, bring your ESA letter and ask your HR department if they might be willing to accommodate you and your companion animal.

Utah's ESA Travel Laws

As of early 2021, changes to the Air Carrier Access Act no longer require airlines to accept ESAs onboard their flights. While service animals still have this protection, only some airlines now choose to accommodate emotional support animals. 

You'll need to call the airline ahead of time to find out if they will allow your ESA to board the flight with you in the cabin. If not, you'll need to submit to the airline’s regular pet policies and fees in order for your animal to travel with you. 

Utah public transportation also is not required to accept ESAs. To use public transportation or be ensured acceptance in public places, an animal must be designated as a service dog (more detail on this in the FAQ section).
