* For Arkansas, California, Iowa, Louisiana and Montana residents, new laws requires those seeking an ESA letter to establish a client-provider relationship with the individual for at least 30 days prior to providing documentation, which will result in having two consultations before qualifying.
Emotional support animals are fully recognized in Puerto Rico and are offered legal protections for housing under the federal Fair Housing Act. While no specific ESA laws exist, ESAs are protected in terms of housing in Puerto Rico. Until 2021, ESAs were also protected under the Department of Transportation’s Air Carrier Access Act (ACAA). However, these rights have since been removed as of 2021 and ESA travel on airlines is at the discretion of the airline. Oftentimes those traveling with ESAs will have to pay special pet travel fees.
The Federal Fair Housing Act (FHA) safeguards the rights of those with ESAs by protecting the right to fair housing access. Under this law, housing providers cannot discriminate against tenants with ESAs, even if the housing complex or apartment does not allow pet animals. While there are certain instances where housing providers can deny ESAs - for example if the animal is aggressive or too big for the establishment - they must make reasonable accommodations for them.
To qualify for an ESA, you must have a qualifying emotional or mental health disability. For example, depression, social anxiety, chronic stress, panic disorder, OCD, bipolar, or PTSD. You must then meet with a licensed mental health practitioner who is licensed in Puerto Rico. They will assess your ESA needs and once confirmed, write a letter in support of your ESA.
