In Kansas, emotional support animals are considered animals that provide safety, comfort, or companionship to a person with a psychiatric or emotional condition.
Although they benefit people with psychiatric challenges, ESAs are not synonymous with psychiatric service animals. Psychiatric service animals are trained to perform specific tasks, like retrieving medicine, whereas ESAs are not.
Because ESAs are not considered the same as psychiatric service animals (or other types of service animals) in Kansas, not all the same laws apply to them. For example, ESAs are not protected by the Americans with Disabilities Act (or the ADA).
The ADA allows service animals to be accepted and accommodated in public spaces like restaurants or grocery stores. However, it does not grant the same permissions to ESAs.
Although the ADA doesn’t cover ESAs, they are protected by other federal laws, including the Fair Housing Act and the Air Carrier Access Act.
The Fair Housing Act states that landlords must allow ESAs as long as they have proper documentation (such as an ESA letter from a licensed professional). The law states that pet deposits and pet policies do not apply in these cases, either.
The Air Carrier Access Act permits ESAs in the cabins of airplanes (with proper documentation).
Anyone with a mental health condition who gets comfort or a sense of safety from an animal could qualify for an ESA. Examples include those with anxiety disorders, depression, post-traumatic stress disorder, and attention-deficit hyperactive disorder.
A mental health professional such as a therapist or psychologist must evaluate anyone who wants an ESA to determine whether or not they’d benefit. If the professional thinks the ESA would help the person being assessed, they will grant them a letter stating so.
